When trusts are submitted to the Department for review, it is necessary to include all appropriate information in order for the trust to be reviewed in a timely manner.  Following are instructions to follow when requesting a review of a trust document:

  1. Submit all trusts (and verifications) directly to the Legal Advisory Unit.
  2. Identify who is applying for which benefits (e.g. Medicaid nursing care, Medicaid on-nursing care, Food Stamps, TANF, etc.)
  3. Send the complete trust agreement (signed, dated, and notarized) and all pages and attachments.
  4. Provide verification of all assets owned by the trust;
  5. The value of each asset;
  6. When each asset was transferred to the trust; and
  7. Who transferred the assets to the trust.
  1. Provide any other documents or information you think may be relevant (like schedules, powers of attorney, financial statements, etc.
